Buggy Do – Terms and Conditions

Welcome to Buggy Do. These Terms and Conditions govern the use of our website, booking platform, and the purchase or reservation of tours, excursions, buggy rides, ATV experiences, UTV/Polaris experiences, transportation, and other activities offered through Buggy Do.

By accessing our website or completing a reservation, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.

1. About Buggy Do

Buggy Do is an online platform specializing in the discovery, comparison, promotion, and booking of buggy, ATV, UTV, Polaris, and other adventure experiences primarily in Punta Cana and other areas of the Dominican Republic.

Depending on the experience purchased, the activity may be operated directly by Buggy Do or by an independent local tour operator, transportation provider, park, attraction, or other third-party service provider.

When an independent provider operates an experience, that provider is responsible for the operational execution of the activity, including vehicles, guides, routes, safety procedures, and other operational components under its control.

Buggy Do remains responsible for the services and obligations that applicable law assigns to it and nothing in these Terms is intended to waive rights that cannot legally be waived.

2. Acceptance of Terms

By making a reservation through Buggy Do, you confirm that:

  • You are legally capable of entering into a binding agreement.

  • The information provided during booking is accurate.

  • You have reviewed the description and requirements of the selected experience.

  • You accept these Terms and Conditions.

  • You are authorized to make the reservation on behalf of all participants included in the booking.

The person making the reservation is responsible for communicating relevant tour information, requirements, and these Terms to the other participants in the reservation.

3. Reservations

Reservations are subject to availability.

A booking is considered confirmed once the customer receives a booking confirmation from Buggy Do or the applicable booking system.

Customers are responsible for reviewing their confirmation immediately and notifying Buggy Do of any incorrect information.

This includes:

  • Tour selected

  • Date

  • Number of participants

  • Vehicle configuration

  • Pickup information

  • Contact information

  • Other booking details

Failure to report incorrect information may affect our ability to provide the reserved service.

4. Prices

Prices are displayed in the currency indicated during the booking process.

Depending on the experience, pricing may be based on:

  • Per person

  • Per vehicle

  • Single buggy

  • Double buggy

  • Family buggy

  • ATV

  • UTV

  • Polaris

  • Private group

  • Other vehicle or passenger configurations

Customers must review the pricing unit carefully before completing payment.

Prices may change until a reservation is confirmed.

Once a booking has been confirmed and paid, its price will generally not change unless the customer requests a modification or an obvious pricing or technical error occurred.

5. Single, Double, and Family Vehicle Configurations

Vehicle configurations vary between experiences.

A Single Buggy generally refers to one participant using the vehicle without sharing it with another paying participant.

A Double Buggy generally refers to a vehicle configured for up to two participants.

A Family Buggy generally refers to a larger vehicle designed to accommodate additional passengers according to the specific vehicle configuration.

Actual capacity varies by vehicle and tour.

Customers must select the correct vehicle configuration for their group.

A single-rider or single-occupancy surcharge may apply when one participant requires exclusive use of a vehicle.

Any applicable surcharge should be disclosed during booking or before the customer agrees to the additional charge.

6. ATV, UTV, and Polaris Experiences

ATV, UTV, Polaris, buggy, and similar off-road vehicles have different operating characteristics and passenger capacities.

Customers must review the vehicle description before booking.

Buggy Do does not guarantee a specific vehicle model, brand, engine size, color, or manufacturing year unless explicitly stated in the confirmed product description.

When an experience is marketed specifically as a Polaris experience, any material substitution will be communicated when reasonably possible and handled according to applicable consumer rights and the circumstances of the booking.

7. Driver Requirements

Driver requirements vary by activity and provider.

Depending on the experience, drivers may be required to:

  • Meet a minimum age

  • Present valid identification

  • Present a valid driver's license

  • Follow safety instructions

  • Demonstrate the ability to safely operate the vehicle

  • Sign an activity waiver when legally permitted

The exact requirements displayed for the selected experience take precedence over general information contained elsewhere on the website.

Participants who fail to meet mandatory driving requirements may be denied permission to drive.

When possible, an alternative passenger arrangement may be offered, but availability is not guaranteed.

8. Children and Minimum Age Requirements

Minimum passenger and driver ages vary by experience.

There is no universal minimum age applicable to every Buggy Do activity.

Parents and guardians are responsible for reviewing the age, height, weight, or other participation requirements displayed for the selected experience before booking.

A parent or legal guardian must provide any consent required for a participating minor.

9. Health and Physical Requirements

Off-road activities may involve:

  • Rough terrain

  • Sudden movements

  • Vibration

  • Mud

  • Dust

  • Water

  • Heat

  • Physical exertion

  • Entering or exiting vehicles

  • Walking on uneven surfaces

Certain experiences may not be appropriate for participants with specific medical or physical conditions.

Customers should carefully review the restrictions displayed on the selected experience.

Participants are responsible for determining whether they can safely participate and should seek appropriate medical advice when they have concerns about a medical condition.

10. Pregnancy

Off-road buggy, ATV, UTV, and similar activities are generally not recommended for pregnant participants because of rough terrain, vibration, sudden movement, and other inherent characteristics of these activities.

Specific restrictions established by the operator of the selected experience apply.

If pregnancy is listed as a participation restriction, the participant may not participate in the applicable activity.

11. Alcohol and Drugs

Participants may not operate an off-road vehicle while under the influence of alcohol, illegal drugs, or any substance that may impair their ability to safely operate the vehicle.

The operator may refuse participation to any person reasonably believed to be impaired.

Illegal drugs are strictly prohibited during Buggy Do experiences.

Unsafe, threatening, abusive, or seriously disruptive behavior may also result in removal from an activity.

No refund will be owed when participation is lawfully refused or terminated because a participant violates these safety rules, subject to applicable consumer law.

12. Safety Instructions

All participants must follow the safety instructions provided by guides and operators.

Depending on the activity, participants may be required to use:

  • Helmets

  • Seat belts

  • Protective eyewear

  • Other safety equipment

Customers must not intentionally misuse vehicles, ignore guide instructions, leave authorized routes, race other participants, perform dangerous maneuvers, or operate vehicles recklessly.

Failure to follow safety instructions may result in immediate termination of participation.

13. Assumption of Inherent Risk

Buggy, ATV, UTV, Polaris, and other off-road activities involve inherent risks that cannot be completely eliminated.

These may include, among other things:

  • Uneven terrain

  • Mud

  • Dust

  • Water

  • Vehicle movement

  • Slips and falls

  • Collisions

  • Weather conditions

  • Natural environments

  • Other participants

By voluntarily participating, customers acknowledge the ordinary and inherent risks associated with the activity.

This provision does not exclude or limit liability where doing so would be prohibited by applicable law, including liability arising from negligence or other conduct for which liability cannot legally be excluded.

14. Vehicle Damage

Participants are expected to operate vehicles responsibly and follow all instructions.

A participant may be financially responsible for damage caused by intentional misconduct, reckless operation, prohibited use, or other conduct for which the participant is legally responsible.

Normal wear and tear, ordinary mechanical failure, and damage not caused by the participant will not be charged to the customer.

Where a damage charge is claimed, the operator should provide a reasonable explanation of the damage and the basis for the charge.

15. Personal Belongings

Customers are responsible for their personal belongings.

Off-road environments can expose belongings to:

  • Dust

  • Mud

  • Water

  • Impact

  • Loss

Customers should avoid bringing unnecessary valuables and should protect phones, cameras, wallets, passports, and other sensitive items appropriately.

Buggy Do and activity providers are not responsible for loss or damage to personal belongings except where liability is imposed by applicable law.

16. Photos and Videos

Some activity providers may offer professional photographs or videos during an excursion.

Unless explicitly included in the product description, professional photos and videos are not included in the tour price and may be offered as optional purchases.

Customers are not obligated to purchase these services.

17. Hotel Pickup and Transportation

Transportation availability depends on the selected experience and accommodation location.

Pickup may be provided from:

  • Hotel lobby

  • Main entrance

  • Security gate

  • Designated meeting point

  • Another confirmed pickup location

Some resorts restrict access to third-party transportation providers.

In those cases, customers may be required to meet the vehicle at a designated location.

Customers are responsible for providing the correct hotel or accommodation information.

18. Pickup Times

Pickup times may be provided as an estimated time or pickup window.

Transportation for shared excursions may involve collecting participants from multiple hotels.

Traffic, resort access procedures, weather, and operational conditions can affect pickup times.

Customers should be ready at the confirmed pickup location before the scheduled time and keep their phone available for operational communication.

19. Late Arrivals and No-Shows

Customers are responsible for arriving at the designated pickup or meeting point on time.

A participant may be considered a no-show when they:

  • Are not present at the confirmed location

  • Arrive after the tour or transportation has departed

  • Provide incorrect pickup information that prevents service

  • Fail to respond to reasonable attempts to contact them

  • Choose not to participate after the tour has been dispatched

No-shows are generally non-refundable, subject to the specific cancellation policy displayed during booking and applicable consumer law.

20. Cancellation by the Customer

The cancellation policy applicable to a reservation will be displayed during the booking process and/or on the booking confirmation.

When an experience offers free cancellation up to a specified deadline, cancellation must be received before that deadline.

Cancellations received after the applicable deadline may be partially refundable or non-refundable according to the policy of the selected experience.

The cancellation terms presented and accepted at checkout form part of the booking agreement.

21. Changes to a Reservation

Requests to change a reservation date, time, participant count, vehicle, or pickup location are subject to availability.

Any price difference resulting from a requested modification may be charged to the customer.

Buggy Do will make reasonable efforts to accommodate changes but cannot guarantee availability.

22. Weather Conditions

Buggy and ATV experiences are outdoor activities.

Light rain, mud, clouds, or normal tropical weather conditions do not automatically result in cancellation.

In fact, muddy conditions may form part of the off-road experience.

However, an operator may delay, modify, reschedule, or cancel an activity when weather conditions create a material safety concern or make operation impractical.

If the operator cancels an experience and a reasonable alternative cannot be provided, customers will be offered the remedy required by the applicable booking terms and consumer law, which may include rescheduling or a refund.

23. Hurricanes, Tropical Storms, and Force Majeure

Events outside reasonable control may affect operations, including:

  • Hurricanes

  • Tropical storms

  • Flooding

  • Government restrictions

  • Road closures

  • Natural disasters

  • Civil disturbances

  • Public emergencies

  • Other extraordinary events

Buggy Do will make reasonable efforts to assist affected customers with available alternatives.

Refunds, credits, or rescheduling will depend on the circumstances, services actually provided, supplier policies where applicable, and mandatory consumer rights.

24. Changes to Itinerary

Tour routes and stops may occasionally change because of:

  • Weather

  • Road conditions

  • Safety concerns

  • Attraction closures

  • Traffic

  • Government restrictions

  • Operational circumstances outside reasonable control

Operators may make reasonable changes necessary to safely complete an experience.

If a material part of the purchased experience cannot be provided, Buggy Do will address the situation according to the circumstances, the applicable booking terms, and mandatory consumer rights.

25. Macao Beach, Caves, Cenotes, and Other Stops

References to Macao Beach, caves, cenotes, ranches, local communities, tastings, or other attractions apply only when those stops are specifically included in the selected product.

Customers should not assume that every Buggy Do experience includes:

  • Macao Beach

  • A cave

  • A cenote

  • Swimming

  • Coffee tasting

  • Cacao tasting

  • Mamajuana tasting

  • Shopping stops

The confirmed product description determines the included itinerary.

26. Third-Party Operators

Buggy Do may work with independent tour operators and service providers.

Where an independent provider operates the activity, customers may also be required to comply with reasonable operational and safety rules established by that provider.

Buggy Do carefully selects commercial partners but does not control every operational decision made by an independent provider.

Nothing in this section eliminates any responsibility Buggy Do may have under applicable law for the booking or services sold through its platform.

27. Complaints and Service Issues

If a problem occurs during an activity, customers should report it as soon as reasonably possible so the operator and Buggy Do have an opportunity to address the issue.

Complaints submitted after the experience should include:

  • Booking number

  • Customer name

  • Date of activity

  • Description of the issue

  • Relevant photographs or supporting information when available

Buggy Do will review complaints fairly and may consult the operating provider when necessary.

28. Refunds

Approved refunds will generally be returned to the original payment method.

Processing times may vary depending on:

  • Payment processor

  • Card issuer

  • Bank

  • Currency

  • Payment method

Buggy Do cannot control additional processing time imposed by financial institutions after a refund has been issued.

29. Chargebacks and Payment Disputes

Customers should contact Buggy Do first when they believe there is a billing or service issue so we have an opportunity to investigate and resolve it.

Nothing in these Terms prevents customers from exercising legitimate rights available through their card issuer, payment provider, or applicable consumer protection law.

Fraudulent payment disputes or intentional misrepresentation of services received may be challenged using booking records, communications, attendance records, and other relevant evidence.

30. Website Information

Buggy Do makes reasonable efforts to keep product descriptions, prices, photographs, availability, and other information accurate.

However, occasional errors may occur.

Images may be illustrative unless explicitly identified as depicting the exact vehicle or attraction included.

If a material error affects a reservation, Buggy Do will contact the customer and provide appropriate options.

31. Intellectual Property

Unless otherwise stated, the Buggy Do name, branding, original website content, graphics, design elements, and other proprietary materials are protected by applicable intellectual property laws.

Third-party trademarks, vehicle brands, attraction names, photographs, and other materials remain the property of their respective owners.

References to brands such as Polaris do not imply sponsorship or endorsement unless expressly stated.

32. Prohibited Website Use

Users may not use the Buggy Do website to:

  • Commit fraud

  • Make fraudulent reservations

  • Attempt unauthorized access

  • Introduce malicious software

  • Scrape protected content in violation of applicable law or contractual restrictions

  • Impersonate another person

  • Interfere with website operation

  • Violate applicable laws

Buggy Do may restrict access or cancel fraudulent transactions where legally permitted.

33. Limitation of Liability

To the maximum extent permitted by applicable law, Buggy Do will not be liable for indirect, incidental, special, or consequential losses that were not reasonably foreseeable and that arise from circumstances outside Buggy Do's legal responsibility.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, willful misconduct, or any other liability that cannot legally be excluded or limited.

34. Governing Law

These Terms and Conditions are governed by the applicable laws of the Dominican Republic, without prejudice to any mandatory consumer protection rights that may apply to a customer based on applicable law.

Any dispute that cannot be resolved amicably will be submitted to the competent authorities or courts as determined by applicable law.

35. Privacy

Personal information collected through Buggy Do is handled according to our Privacy Policy and applicable data protection requirements.

Information necessary to fulfill a reservation may be shared with the tour operator, transportation provider, payment processor, or other service provider involved in delivering the purchased experience.

36. Electronic Communications

By making a reservation, customers agree to receive communications reasonably necessary to manage their booking, including:

  • Booking confirmations

  • Pickup instructions

  • Schedule changes

  • Safety or operational notices

  • Customer service messages

These transactional communications are separate from optional marketing communications.

37. Updates to These Terms

Buggy Do may update these Terms and Conditions periodically.

The version applicable to a confirmed reservation will generally be the version in effect when the booking was made, except where a change is required by law or is more favorable to the customer.

The latest version will be published on the Buggy Do website with its effective or updated date.

38. Contact Buggy Do

Questions about a reservation, cancellation, refund, or these Terms and Conditions should be submitted through the official contact methods published on BuggyDo.com.

When contacting us about an existing reservation, please provide your booking number so our team can locate the reservation efficiently.

By completing a reservation with Buggy Do, you confirm that you have reviewed and accepted these Terms and Conditions, including the applicable cancellation policy, participant requirements, vehicle configuration, and activity information displayed for your selected experience.
